PEAPAC Recommends: NO

Violates biblical liability (Open Pit law – Ex 21); those who create a situation (PGE) should bear the cost, not ratepayers.

Summary

Allows utilities (like PGE) to charge ratepayers for retired property (like the Trojan nuclear plant).

Biblical Reasoning

Biblical law (Ex. 21:33,34) says that a man who leaves an open pit that causes harm to others is responsible for covering the pit, and for any damages. In our view, Measure 90 transfers responsibility for open pits to those who did not create them – ratepayers.

Exodus 21:33,34 — “Biblical law (Ex. 21:33,34) says that a man who leaves an open pit that causes harm to others is responsible for covering the pit, and for any damages.”

Full PEAPAC Analysis

PEAPAC Explanation: If passed, Measure 90 would let the PUC (Public Utility Commission) set rates that would let public utilities receive a profit on property that is not currently being used to provide services to customers. This Measure, referred by the Legislature, is part of the continuing saga of PGE’s Trojan nuclear plant.

It seems to us a bailout plan for PGE, which we oppose. PGE did get a rather raw deal in the long and highly political struggle over Trojan’s safety. But this law would open a door for ratepayer-financed bailouts for poor business decisions of public utilities.

Biblical law (Ex. 21:33,34) says that a man who leaves an open pit that causes harm to others is responsible for covering the pit, and for any damages. In our view, Measure 90 transfers responsibility for open pits to those who did not create them – ratepayers. We ask you to vote No on Measure 90.
