PEAPAC Explanation: If passed, Measure 86 would put Oregon’s so-called “Kicker Law” into the State Constitution, taking away the ability of the Legislature to spend the “kicker.” In 1979, the Oregon Legislature passed the “Kicker Law.” When income tax collections exceed the state’s estimates by 2 percent or more, the excess must be returned, “kicked” back, to taxpayers. But the Legislature can bypass the law by voting to spend the money. This Measure would put the kicker law into the Constitution, totally removing the ability of the Legislature to spend it.
